SPSA ISSUES STATEMENT
ON TODAY’S SUPREME COURT DECISION
(April 30, 2007 Chesapeake, VA) – SPSA was apprised today of a decision by the United States Supreme Court upholding the right of local governments to direct the flow of trash within their borders (i.e., flow control), to facilities owned and operated by a state‑created authority. We are assessing the situation with legal counsel, and are examining how this decision will impact operations within SPSA. The implications of this decision may not be fully understood for several weeks. The case is United Haulers Association, Inc. v. Oneida‑Herkimer Solid Waste Management Authority.

SPSA has been providing
efficient and environmentally sound waste disposal services to the region
and its residents since 1985. SPSA’s solid waste management system
includes waste-to-energy, yard waste composting, drop-off and curbside
recycling as well as other recycling programs, household hazardous waste
collection, landfilling, landfill gas-to-energy and education programs.
This integrated waste management system enables SPSA to put 57% of the
waste it receives to a beneficial use, thus allowing the region to reduce
its dependence on landfills.
